Name Dispute Policy
Effective date: 4 November 2026
Last updated: 4 November 2026
This policy explains what to do if a NemKad address uses your name, your organisation's name or your trademark, and how we decide. It applies to personal card addresses (nemkad.com/name) and organisation addresses (nemkad.com/organisation), which come from the same pool of names. It is run by NEMKAD SOLUTIONS, registration number 202603223322 (003882261-V) ("NemKad", "we"), and it adds to section 4 of our Terms of Service.
1. What we do before anyone has to complain
- We keep a reserved list of names belonging to well-known organisations, banks, telecommunications companies, government agencies and major brands. Those names cannot be claimed by anyone.
- A new organisation name that reads like a registered business is not issued automatically. It is held for review, and we may ask for evidence that you are connected to that business before it goes live.
- Addresses are allocated first come, first served, and claiming one gives you a licence to use it while your account is in good standing — not ownership of the name (Terms, section 4).
2. The two kinds of complaint
Impersonation — a card or organisation page is presenting itself as you, your business or your organisation, or is set up so that people would reasonably believe it is. We treat this as urgent.
Name or trademark conflict — an address matches a name or mark you have rights in, without anyone pretending to be you. We treat this carefully but not urgently.
If the problem is the content on a card rather than the address — abuse, false claims, someone using your photo — use the report button on the card or write to us. That is a different process and usually faster.
3. How to make a claim
Email helpline@nemkad.com with "Name dispute" in the subject, and include:
- The exact address you are complaining about.
- The name or mark you say it conflicts with.
- Your rights in that name — a business registration number (SSM), a trademark registration (MyIPO or equivalent), or, for a personal name, how the name is yours.
- Evidence you are the person or are authorised to act for the organisation.
- For impersonation: what the page is doing that misleads people.
- A statement that what you have told us is accurate.
We acknowledge claims within 5 working days. We do not act on anonymous complaints, and we do not act on an assertion alone — we need enough to make a decision we can stand behind.
4. How we decide
We release an address only where all three of these hold:
- The address is identical or confusingly similar to a name or mark you have rights in; and
- The person holding it has no legitimate interest in that name; and
- They registered it or are using it in bad faith.
Legitimate interest includes: it is their own name, nickname or how they are known; it is the name of a business they actually run; it is an ordinary word or a common surname; or they have been genuinely using the address for its obvious purpose. Someone whose family name happens to match a company keeps their address.
Bad faith includes: holding several company-style names with nothing on them; offering to hand the address over for payment; presenting the page as the organisation; pointing it at a competitor; or a pattern of taking names other people have rights in.
Matching a name is not by itself enough. The first two tests exist so that ordinary members do not lose addresses they use honestly.
5. What happens to the person holding the address
- We tell them about the claim and give them 14 days to respond. The exception is clear, serious impersonation, where we may suspend the page immediately and hear from them afterwards.
- We never delete their card or their content. If an address is released, they choose a new one and everything they have built moves with it.
- We tell both sides the outcome and the reason.
6. Possible outcomes
| Outcome | What it means |
|---|---|
| No action | The three tests in section 4 are not all met. |
| Address released | The holder moves to a new address. The released name is reserved for 30 days, during which you may claim it. After that it returns to general availability. |
| Page suspended | For impersonation, the page stops being public while we deal with it. |
| Account action | Where there is a pattern of taking names, we may suspend or close the account (Terms, sections 7 and 10). |
We do not transfer an address directly from one member to another. Addresses cannot be bought, sold or traded between members, and that includes as the result of a dispute.
7. Timing
- Acknowledgement: 5 working days.
- Impersonation: assessed within 5 working days.
- Name or trademark conflict: decided within 30 days of receiving a complete claim.
We will tell you if something takes longer and why.
8. If you disagree with our decision
Write to us at helpline@nemkad.com within 30 days and tell us what we got wrong or what is new. One review per dispute.
9. What this policy is not
We are not a court, and a decision here is a practical decision about a NemKad address, not a ruling on who owns a name. It does not affect anyone's legal rights, and either side is free to take the matter further. We will comply with a court order or a lawful direction from a Malaysian authority.
Where two people both have real rights in a name — two businesses with the same registered name in different states, for example — we will not pick a winner. First come, first served stands, and the courts are the place for that.
